If you attempt to bring any legal proceedings against Precoh you specifically acknowledge that Precoh is free to choose the jurisdiction of our preference as to where such action against us may be held. As you have agreed by using this site to choose the laws of the State of Georgia to govern any such proceedings, we will probably choose to defend any such action in Georgia and we can make this decision entirely as it suits us, without regard to where in the world you are located, or from where in the world you visited this site.

You are responsible for complying with the laws of the jurisdiction from which you are accessing this site and you agree that you will not access or use the information on this site in violation of such laws. Unless expressly stated otherwise herein, any information submitted by you through this site shall be deemed non-confidential and non-proprietary. To protect the interests of our current clients and ourselves, we must treat the issue of such submissions with great care. Any ideas disclosed to Precoh outside a pre-existing and documented confidential business relationship are not confidential and Precoh may therefore develop, use and freely disclose or publish similar ideas without compensating you or accounting to you. Precoh will make every reasonable effort to return or destroy any unauthorized idea submissions without a detailed review of them. However, if a review is necessary for Precoh’s sole discretion, it will be with the understanding that Precoh assumes no obligation to protect the confidentiality of your idea or compensate you for its disclosure or use. By shopping and doing business with Precoh, you accept the following terms and conditions, without limitation or qualification. Notwithstanding the foregoing, Precoh shall not be responsible for any loss, damage, or claim relating to the failure of any product supplied to be compliant.

Precoh warrants its products to its initial Customer to be free from defects in materials and workmanship under normal use and service from the date of delivery subject to the manufacturer’s terms warranty.  The warranty covers goods under normal use and in-service under conditions for which the merchandise was designed.  This remedy is exclusive and Precoh does not authorize any person to create for it any other obligation or liability.  Precoh makes no other warranties, either expressed or implied as to any matter whatsoever, including without limitation the condition of the merchandise, its merchantability, or its fitness for any particular use or purpose except as otherwise expressly provided in writing.

This warranty becomes null and void on any product repaired or altered by any person not so authorized by Precoh or on any merchandise which has been damaged or found to be defective due to the Customer’s negligence, lack of care, accident, alteration, misuse, improper storage, improper assembly or installation, improper repair or maintenance, fire or other casualties.

During the warranty period, the exclusive remedy of the Customer is limited to the following: Precoh will have the option to repair, replace, or return the purchase price or some portion thereof, or provide a credit or reimbursement for repair by manufacturer or a third party acceptable to Precoh, of any product which exhibits such material or workmanship defects.  Precoh shall not be liable for commercial loss or any consequential or incidental damages that may arise as a result of any defective product.  The one-year limitation may not apply because some states do not allow limitations on the duration of an implied warranty of the exclusion or limitation of incidental or consequential damage. 

Unless otherwise specified, all amounts are quoted in U.S. funds.  All new account orders require 100% payment due at the time of order.  Account balances are due in full within 7 days after delivery and/or, if applicable, installation (with net terms).  if you are a NET 30 customer, after 30 days, a 1.5 % per month finance charge will be assessed on all past due accounts, commencing as of the date of delivery.  Customers are also responsible for any collection costs, including reasonable attorney fees, incurred by Precoh, LLC.

Precoh, LLC is authorized to collect tax in the State of Georgia and most states.  For all orders with the point of delivery outside of the State of Georgia, and Customers who are exempt from paying sales tax directly to the appropriate government agency, they will be required to indemnify Precoh, LLC against any such liability.
